1. Agreement to Terms

By accessing or using KickPilot ("Service"), operated by Linkpromo Pro LLC, a Wyoming limited liability company located at 1309 Coffeen Ave Ste 1200, Sheridan, WY 82801, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Kickpilot is a bot platform for Kick.com streamers that provides:

• Automated chat moderation
• Custom commands and timers
• AI-powered chat companion
• Stream analytics and viewer insights
• Welcome messages and automated responses
• Other features as described on our website

3. User Accounts

3.1 Account Creation

To use Kickpilot, you must create an account and connect your Kick.com account. You must provide accurate, current, and complete information. You are responsible for maintaining the security of your account and password.

3.2 Account Responsibilities

You agree to:

• Provide accurate and truthful information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account
• Not share your account with others

3.3 Age Requirement

You must be at least 13 years old to use Kickpilot. If you are under 18, you must have permission from a parent or guardian.

4. Acceptable Use Policy

4.1 Prohibited Activities

You agree NOT to use Kickpilot to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Harass, abuse, or harm others
• Spread spam, malware, or viruses
• Attempt to gain unauthorized access to systems
• Interfere with or disrupt the Service
• Use bots or automated systems (other than our bot)
• Scrape or collect data without permission

4.2 Content Responsibility

You are solely responsible for the content your bot sends to your Kick channel, including custom commands, welcome messages, and automated responses. You must ensure your content complies with all applicable laws and Kick.com's community guidelines.

5. Kick.com Integration

Kickpilot integrates with Kick.com through their official API. By using our Service:

• You authorize us to access your Kick account as necessary to provide our services
• You must comply with Kick.com's Terms of Service and Community Guidelines
• We are not responsible for changes to Kick.com's API or policies
• Service interruptions may occur due to Kick.com's platform issues
• We may be required to suspend service if Kick.com terminates API access

6. Subscription and Payment

6.1 Free and Premium Plans

Kickpilot offers both free and premium subscription plans. Premium features, pricing, and limitations are described on our website and may change with notice.

6.2 Payment Terms

For premium subscriptions:

• Payments are processed through secure third-party payment processors
• Subscriptions automatically renew unless cancelled
• You authorize us to charge your payment method for recurring fees
• Prices may change with 30 days notice
• No refunds for partial months or unused features

6.3 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will retain access until then.

7. Intellectual Property Rights

7.1 Our Rights

The Service, including all content, features, and functionality, is owned by Linkpromo Pro LLC and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.

"KickPilot" and our logo are trademarks of Linkpromo Pro LLC. You may not use them without our written permission. Kick.com and related trademarks are owned by their respective owners.

8. Disclaimers and Limitations

8.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

8.2 No Guarantee of Results

We do not guarantee that using Kickpilot will increase your viewers, engagement, or streaming success. Results depend on many factors outside our control.

8.3 Third-Party Services

We are not responsible for the availability, accuracy, or reliability of Kick.com or any other third-party services. Service disruptions may occur due to factors beyond our control.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LINKPROMO PRO LLC (OPERATING AS KICKPILOT) SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Lost profits, data, or business opportunities
• Service interruptions or errors
• Actions or content of third parties
• Unauthorized access to your account
• Bugs, viruses, or other harmful code

Our total liability shall not exceed the amount you paid us in the past 12 months, or $100, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless Linkpromo Pro LLC (operating as KickPilot), its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you send through your bot

11. Termination

11.1 Your Right to Terminate

You may terminate your account at any time by deleting it through your account settings or by contacting support.

11.2 Our Right to Terminate

We may suspend or terminate your account immediately, without prior notice, if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• Your account is inactive for an extended period
• We discontinue the Service
• Required by law or third-party requirements

11.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We may delete your data in accordance with our Privacy Policy. Provisions that should survive termination (including disclaimers, limitations of liability, and indemnification) will remain in effect.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by email or through a prominent notice on the Service. Continued use after changes constitutes acceptance of the modified Terms. Material changes will take effect 30 days after notice.

13. Governing Law and Disputes

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in the State of Wyoming. You waive the right to participate in class actions.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer your rights under these Terms without our consent. We may assign our rights and obligations without restriction.
